The Employment Standards Act (ESA) applies to employees.

A staff member consists of a person who:

– carries out work for an employer for earnings

– supplies services to a company for salaries

– receives training from an employer, if the skill in which the person is being trained is an ability used by the company’s staff members

– is a homeworker

– was an employee

Effective March 21, 2024, a worker includes a person who carries out work throughout a trial duration for an employer, if the abilities being evaluated during the trial duration are abilities used by the employer’s staff members or could be utilized by staff members if there are no other employees. For instance, where an employer of a restaurant asks a job candidate to work a trial shift waiting tables to show their ability to carry out the job, even where no work deal has actually been made to that prospect, the is a staff member under the ESA.

The ESA does not apply to independent professionals, volunteers or other people who are not covered under the ESA. A private thought about a worker might be entitled to rights such as:

– base pay

– overtime pay

– public vacations

– getaway with pay

– notification of termination or termination pay

Under the ESA, companies are not permitted to deal with staff members covered by the Act as if they are not staff members. If an employer misclassifies an employee in this method, an employment requirements officer can issue a notification of conflict that results in a charge, a prosecution or employment both versus the company.

Please note, the ESA supplies minimum requirements only. Some workers might have greater rights under an employment agreement, cumulative contract, the common law or other legislation.

How to tell who is a staff member

A person may be thought about a staff member under the ESA when a minimum of some of the following describes the relationship:

– the work the individual performs is a vital part of the service

– the organization chooses:- what the person is to do

– how much the individual will be paid

– where and when the work is carried out

How to inform who is an independent professional

An independent specialist is someone who is in organization on their own. A person may be considered an independent professional, employment and not covered by the ESA, when at least a few of the following applies:

– the service can end the person’s contract for services, employment but can not discipline the person

– the person:- has the opportunity to make a profit and has a risk of losing money from the work

– determines how, when or where the work is performed

– decides whether to farm out some of the work

Example

Fariah works as a customer support agent for a sales service. She needs to work Monday to Friday from 9:00 a.m. to 5:00 p.m. in business’s office. She uses business’s telephones and computers. She is paid $25.50 per hour. Her employment agreement does not have an end date, although her company can fire or discipline her for poor performance. Her employment agreement specifies that she is an independent professional therefore she does not receive overtime pay, vacation pay or public holiday pay.

Fariah believes she may in fact be a worker and may be entitled to overtime pay, vacation pay and public vacation pay. She sues with the Ministry of Labour, Immigration, Training and Skills Development.

An employment standards officer investigates her claim. The officer takes a look at the relationship in between Fariah and employment the sales company and employment discovers that she is an employee

It does not matter that Fariah signed the employment agreement specifying that she is an independent contractor because the facts reveal she is a worker.

The employment standards officer orders the sales company to:

– pay Fariah the overtime pay, getaway pay and public holiday pay that she was entitled to as a staff member.

– orders the company to issue wage statements and keep records

Employee or independent contractor: employment Common misconceptions

A person might be thought about an employee even if:

– the specific and business agree (orally or in composing) that the individual is an independent contractor. It is the relationship between the individual and the service (or person) that matters, not the label that is offered to it

– the person:- charges the balanced sales tax (HST).

– sends billings to the service.

– uses their own lorry for employment work functions.

Volunteers

Volunteers are not staff members under the ESA. However, the truth that someone is called a « volunteer » does not figure out whether that person is a worker and entitled to the defenses of the ESA.

The main elements that determine whether somebody is a volunteer or an employee are how much:

– business (or individual) advantages from the person’s services.

– the private views the arrangement as remaining in pursuit of a living.

In family-run services, the concern will typically be whether the person is offering services in pursuit of a living or in service of the family.

If the person is offering services to the family, instead of services in pursuit of a living, that individual is more most likely to be a volunteer.

The fact that no incomes were paid does not necessarily suggest that somebody is a volunteer. The fact that there was some form of payment does not necessarily suggest somebody is an employee. For instance, an honorarium may have been paid, rather than salaries.
